EU-Gerichtsurteil: Weiterverkauf digitaler Spiele muss erlaubt sein

Der Gerichtshof der Europäischen Union hat entschieden, dass Verbraucher innerhalb der EU heruntergeladene Spiele und Software legal weiterverkaufen können, und hob damit die durch Endbenutzer-Lizenzverträge (EULAs) auferlegten Beschränkungen auf. Diese wegweisende Entscheidung, die aus einem Rechtsstreit zwischen UsedSoft und Oracle hervorgegangen ist, basiert auf dem Grundsatz der Erschöpfung der Vertriebsrechte. Sobald ein Urheberrechtsinhaber eine Kopie verkauft und unbegrenzte Nutzungsrechte gewährt, gilt das Verbreitungsrecht als erschöpft und erlaubt den Weiterverkauf.

Dieses Urteil betrifft große Plattformen wie Steam, GOG und Epic Games. Der ursprüngliche Käufer kann die Spiellizenz rechtmäßig übertragen, sodass ein neuer Besitzer das Spiel herunterladen kann. Das Gericht stellte klar, dass der ursprüngliche Käufer beim Weiterverkauf auf den Zugriff verzichtet. Allerdings bleiben praktische Auswirkungen bestehen, darunter das Fehlen eines definierten Wiederverkaufsmarktplatzes und ungelöste Fragen zu Kontoübertragungen. Physische Kopien bleiben beispielsweise unter dem Konto des ursprünglichen Eigentümers registriert.

Wichtig ist, dass das Urteil es dem ursprünglichen Verkäufer nicht erlaubt, nach dem Weiterverkauf weiterhin Zugriff zu behalten. Das Gericht betonte, dass eine weitere Nutzung nach dem Verkauf die Vervielfältigungsrechte des Urheberrechtsinhabers verletzen würde. Solange das Verbreitungsrecht erschöpft ist, bleibt das Vervielfältigungsrecht bestehen und erlaubt nur Kopien, die für die rechtmäßige Nutzung durch den neuen Eigentümer erforderlich sind. Dadurch kann der neue Besitzer das Spiel für den beabsichtigten Gebrauch herunterladen.

Darüber hinaus stellte das Gericht klar, dass Sicherungskopien nicht weiterverkauft werden dürfen. Diese Einschränkung gilt für alle rechtmäßigen Erwerber von Computerprogrammen. Die Entscheidung verdeutlicht die Grenzen der Erschöpfung des Urheberrechts im Kontext der digitalen Verbreitung und hat Auswirkungen darauf, wie Verbraucher und Herausgeber mit dem Besitz digitaler Spiele in der EU interagieren.
